When you have been charged with an OVI, you will face the typical punishments that you might face after committing a different type of crime such as fines and imprisonment. However, an OVI often comes with several other penalties including the requirement to obtain SR22 insurance. SR22 insurance is much more expensive and is another reason why you want to have your charges dismissed by an experienced OVI defense attorney.

While it is often referred to as SR22 insurance, this type of insurance is actually a certificate of endorsement which your state will require so that your license can be reinstated. This is to make sure that you are not driving without a license.

With this type of coverage, the insurance provider is required to notify the state if your insurance coverage lapses. If this occurs, your license will be suspended once again. 

How to Avoid the SR22 Insurance Requirement

In many states, SR22 insurance is mandatory after an OVI. As a result, you will need to beat your OVI charges to be able to avoid any of the consequences of the charge. Police officers often make mistakes when trying to investigate an OVI case and you may be able to beat your OVI case as a result.

Field Sobriety Tests

You might have not even consumed alcohol on that day, but you could be falsely accused of an OVI after failing to properly perform a field sobriety test. These tests can often be confusing and the officer might require you to perform the test while wearing high heels, on a slippery surface, or on an incline. Being nervous can also lead you to make a mistake.

Breathalyzer, Urine, and Blood Tests

Some breathalyzer tests can be thrown out because the breathalyzer was not properly calibrated. Both blood and urine tests can fail if the samples are not stored properly. You also have the right to leave the custody of the police to have your own independent test performed. If you are not given the opportunity to do this, you might be able to have your charges dropped.
