5 Steps to Take If You're Experiencing Discrimination at Work

Law Blog

As an employee, you are entitled to work in a safe environment. A number of different federal laws protect employees from various forms of discrimination, and discrimination towards age, sex, race, color, sexual orientation, or disabilities is prohibited. If you feel that you are being discriminated against in the workplace, it is important to take action. Use the following tips if you're an employee who is experiencing discrimination:

Have a Confrontation

It is an unfortunate fact that many managers and supervisors who violate discrimination laws may be completely oblivious to what they are doing. If you are feeling uncomfortable at work due to discrimination, a good first step is to confront the person violating the law. In the best case scenario, explaining how you feel and pointing out that federal laws are being broken will end the comments or behavior.

File a Complaint With the HR Department

In the event that you continue to deal with discrimination after confronting the person displaying discriminatory behavior, it is important to file an official complaint with your company's HR department. After filing the complaint, make sure you get a copy of it for your records. Once the complaint is filed, your employer will be required to investigate and come to a satisfactory resolution to end the discrimination.

Consult the Employee Handbook

Many companies have an official anti-discrimination policy, which is often outlined in the employee handbook. It is in your best interest to consult the handbook and learn as much as you can about your employer's policy. If they fail to follow policy and resolve the matter promptly, having a copy of the policy can be very favorable to you.

Keep a Journal

When you're being discriminated against at work, it is very important to keep written records of each incident. Having a small notebook on hand will make it easy to jot down the date, time, and the details of any discriminatory behavior you experience while on the clock.

Hire a Lawyer Who Specializes in Discrimination Cases

If your employer does not investigate and resolve discriminatory behavior, you may need to hire a lawyer and file a lawsuit. Your discrimination attorney will be able to collect evidence and work on your behalf to show that federal discrimination laws were broken. When you have an attorney representing you and working on your behalf, you have a better chance of winning your case and collecting compensation. Legal Help: Hiring a Family Attorney

Several years ago. I found myself facing a suit as the result of a traffic accident. Fortunately, a friend knew a great car accident attorney who was willing to take my case. She represented me well and the suit was eventually dismissed. That woke me up to the fact I needed an attorney to call on for other matters. Fortunately, I found a family attorney who could help with everything from creating last wills and testaments to dealing with personal injury cases. Today, I feel prepared to take on any legal issue that could come along. The trick is to choose the right attorney. Keep reading and I'll share how I made decisions that are right for me. Hopefully those same ideas will help you find legal counsel that you can depend on.
